What information we collect
We collect personal data in four situations:
When you request our brochure. To download the North Gate Farm brochure you give us your email address. We record the email address, the date and time of the request and whether you ticked the box to receive marketing from us.
When you contact us. When you submit the enquiry form, email us or call us, we collect the details you provide, such as your name, email address, telephone number, the content of your message and any preferences you tell us about (for example which home you are interested in). Enquiry form submissions are sent to us by our server as an email message and stored in our mailbox and enquiry records.
When you visit the website. Our web server records technical information about your visit in its log files, including your IP address, browser type and version, the pages you visit and the date and time of each request. We use this to keep the website secure and to understand how it is used.
Security checks on our forms. Our forms use Google reCAPTCHA to protect against spam and automated abuse. Google collects technical information such as your IP address, browser details and how you interact with the page in order to tell whether you are a person or a bot. Google processes this under its own Privacy Policy and Terms of Service; see “Who we share your information with” and “International transfers” below.
We do not collect special category data (such as health, religion or ethnicity) through the website, and we ask that you do not include it in your messages to us.
Cookies. We use cookies and similar technologies on the website. For details, please see our Cookie policy.
How and why we use your information
We only use your personal data where the law allows us to. The table below sets out each purpose and the lawful basis we rely on.
| What we do | Data used | Lawful basis (UK GDPR Article 6) |
|---|---|---|
| Send you the brochure you requested | Email address | Taking steps at your request before entering into a contract (Art 6(1)(b)) and our legitimate interest in providing information about our homes |
| Respond to your enquiry, arrange viewings and discuss a purchase | Name, contact details, message content | Taking steps at your request before entering into a contract (Art 6(1)(b)) and our legitimate interest in responding to people who contact us |
| Send you marketing emails about North Gate Farm and future Cambridge & Country developments | Email address, name | Your consent (Art 6(1)(a)) – see “Marketing” below. You can withdraw it at any time |
| Keep the website secure and prevent spam | IP address, browser and device data, server logs, reCAPTCHA data | Our legitimate interest in running a secure website and preventing abuse (Art 6(1)(f)) |
| Understand how the website is used and improve it | Server logs (aggregated) | Our legitimate interest in operating an effective website (Art 6(1)(f)) |
| Keep records needed by law and deal with legal claims | Enquiry and transaction records | Legal obligation (Art 6(1)(c)) and our legitimate interest in defending claims |
Where we rely on legitimate interests, we have checked that our use of your data is necessary for that purpose and does not override your own interests and rights. You can object to any use based on legitimate interests – see “Your rights”.
We do not make decisions about you using automated processing or profiling, and we do not use your data for any purpose that is incompatible with those listed above.
Marketing
We only send marketing emails to people who have asked for them. When you request the brochure or submit an enquiry you can tick a box to receive updates about North Gate Farm and future Cambridge & Country developments. The box is unticked by default; if you leave it blank we will send you only what you asked for (the brochure, or a reply to your enquiry) and nothing further.
We record when and how you gave consent so that we can show it was given. Every marketing email we send includes an unsubscribe link. You can also withdraw your consent at any time by emailing enquiries@cambridgeandcountry.com, and we will stop within a few working days.
We will not pass your details to any other organisation for their own marketing, and we will not contact you by telephone or text message for marketing purposes unless you have agreed to that.
This section applies the rules in PECR (regulation 22), which govern electronic marketing in the UK.
Who we share your information with
We do not sell your personal data. We share it only with:
- Service providers who help us run the website and our business, such as our website developer and hosting provider, our email provider and our IT support. They act on our instructions under written contracts and may only use your data to provide their service to us.
- Google LLC, which provides the reCAPTCHA service on our forms. Google acts as an independent controller for the technical data it collects through reCAPTCHA and uses it to operate and improve the service.
- Professional advisers and sales partners involved in a purchase, such as selling agent to be confirmed, solicitors and surveyors, where you go ahead with buying a home and this is needed to progress the sale.
- Regulators, courts and law enforcement, where we are required to by law or need to protect our legal rights.
If Cambridge & Country or Cognisant Construction Limited is sold or merged with another business, your data may be transferred to the new owner, who will be bound by this policy.
International transfers
We store and process your personal data in the United Kingdom. One exception is Google reCAPTCHA: the technical data it collects is processed by Google LLC in the United States. Google LLC is certified under the UK Extension to the EU-US Data Privacy Framework, which the UK Government has recognised as providing adequate protection, so this transfer is permitted under UK GDPR without further safeguards.
If we ever need to transfer your data to another country that the UK does not consider adequate, we will only do so under an approved safeguard such as the ICO’s International Data Transfer Agreement, and we will update this policy.
How long we keep your information
We keep personal data only for as long as we need it for the purposes above, after which we delete or anonymise it.
| Data | How long we keep it |
|---|---|
| Brochure request (email address, date) | 24 months from your request, or until you ask us to delete it |
| Enquiries that do not lead to a purchase | 24 months from our last contact with you |
| Records relating to a purchase | 6 years after completion, to meet our legal and contractual obligations |
| Marketing consent and unsubscribe records | For as long as we send you marketing, then 24 months as a record that you unsubscribed |
| Server log files | 90 days, then deleted automatically |
| reCAPTCHA cookie | Up to 6 months (set by Google – see the Cookie policy) |
We may keep data for longer if we need it to deal with a complaint or legal claim, or where the law requires it. You can ask us to delete your data at any time – see “Your rights”.
How we keep your information secure
The website is served over an encrypted (HTTPS) connection, form submissions are delivered to us by secure email, and access to enquiry records is limited to the people who need it to deal with you. Our service providers are required to keep your data secure under their contracts with us.
No method of transmission over the internet is completely secure. If we become aware of a breach that is likely to put your rights at risk, we will tell you and the ICO as the law requires.
Your rights
Under UK data protection law you have the right to:
- Access – ask for a copy of the personal data we hold about you
- Rectification – ask us to correct inaccurate or incomplete data
- Erasure – ask us to delete your data
- Restriction – ask us to limit how we use your data while a concern is resolved
- Objection – object to us using your data where we rely on legitimate interests, and object to direct marketing at any time
- Portability – receive the data you gave us in a machine-readable format, or ask us to send it to another organisation
- Withdraw consent – at any time, where we rely on your consent (for example marketing). Withdrawing consent does not affect processing that happened before you withdrew it
To exercise any of these rights, email enquiries@cambridgeandcountry.com or write to us at the address above. There is no fee, and we will respond within one month. We may ask you to confirm your identity before we act on a request.
Complaints
If you are unhappy with how we have handled your data, please contact us first so that we can try to put it right. You also have the right to complain to the Information Commissioner’s Office (ICO) at any time: ico.org.uk/make-a-complaint, telephone 0303 123 1113, or by post to Information Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF.
Cookies
The website sets only the cookie needed for Google reCAPTCHA to protect our forms; we do not currently use analytics, advertising or other non-essential cookies. If we introduce any, we will ask for your consent through a cookie banner before setting them, as PECR requires, and update our Cookie policy, which lists every cookie we use and how to manage them.
Third-party websites
The website may contain links to third-party websites, including Google’s privacy and terms pages. We do not control those sites and are not responsible for how they collect or use personal data. Please read their privacy policies before submitting any information.
Children
The website is intended for adults interested in buying a home. We do not knowingly collect personal data from anyone under 18. If you believe a child has given us their details, please contact us and we will delete them.
Changes to this policy
We may update this policy from time to time, for example if we change the services we use or the data we collect. The latest version will always be published on this page, with the date it was last updated shown at the top. If a change significantly affects how we use your data, we will tell people who have given us their contact details.
